“Placing of Product on the Market”
Statement from the British Safety Industry Federation (BSIF) and The European Safety Federation (ESF)
The BSIF and The ESF would like to take this opportunity to reassure the supply chains that, for the avoidance of any doubt, PPE which has already been “placed on the market” by April 21st 2019 under the conditions of the Directive 89/686 can continue to be sold without an end date, unless there is an expiry date on the product for technical reasons.
There are still interpretations surrounding the definition of “placing on the market” but for further avoidance of doubt, in an example where product has already been brought into the UK through a commercial transaction and is in stock and subject to live ongoing sales, continues to be offered for sale through catalogues, web sites and through the catalogues of distribution partners, is available for sale and supply, has clearly already been “placed on the market” and can continue to be sold without an end date, or at least until April 2023.
